    We need a GDPR equivalent in the United States. Intrusive, Greedy Scumbags are among the many reasons the US is not the greatest country on the planet. Corporations/business owners who can't compete and manage their operations in ethical fashion, aren't fundamentally good business people. They DGAF about the impact that misusing personal data and information has on the population and their quality of lives. The CCPA is a great start in protecting citizens and consumers -- Fortunately, countless other states have followed suit, since there has been little federal action (which is expected given the power brokers/lobbyists in Washington are in the pockets of the officials who could stop this shit). The CCPA may have been passed quickly, but its broad language is a good thing for consumers, it keeps businesses on their toes and in fear of litigation while giving common-folk real recourse in the event they are harmed by data and information. I realize the business sector and their lobbyists love tedious 1000+ page complex legislation so they can jam up our court systems in civil litigation for years and years, but Americans should have their right to full privacy as if they were off the grid if they choose such. If a citizen says NO, I don't want you to mine or share any data related to my person whatsoever, then that wish should be honored. FFS, this is the United States.

    California created that stalking law that they don't enforce do you suppose they will create privacy laws they don't enforce why do they keep creating laws that they don't ever enforce unless somebody says something they shoot the messenger and they enforce the laws on the victims but not the criminals

    Whatever the situtation , the ultimate truth is tha there is huge need to work upon the laws for the internet, it is not just about the privacy laws , the thing is gone out of hand and there should be sufficient control to restrict the monopolist and the single dominant companies not to mold the society just for their benefits.

    I strongly disagree. Big techs want a federal law because it will be easier to dance around and manipulate. (A noteworthy talking point against communism theorist). With privacy acts being statewide and distinctive they have to follow the the lowest layer minimum of law which is to keep consumer acts private.

    I recently was told this to . And at first I did do everything and logged in like the link directed me to and then I just had a weird feeling about it . So I changed my password a few min later they told me that the “information” wasn’t correct . But really it’s cause I had changed my password so they couldn’t get in .

    Thank you so much for doing this video! For out of state retailers - does this include people who sell e-books as well? So if I sell an e-book on my landing page and someone from Oklahoma or New Jersey buys my e-book, I would have to collect out of state sales tax (I'm in New York)? Also, the example you gave with 150,000 dollars or 200 transaction threshold ... Now, this next question may sound like a dumb one lol but I'll try to ask. Okay, now suppose you made 100,000 dollars from e-book purchases in South Dakota but don't collect sales tax. Could you just take whatever you owe in sales tax from out the 150,000 dollars? I understand I'll be losing money (100,000 x 4.5%) = $4,500 I'd have to take out from my gross profit of 150,000 dollar threshold to pay back the taxes. I only ask this because I supposed I don't always reach the 100,000 dollar or 200 transaction threshold every month or every quarter (or whatever their timeframe guideline is that particular state)?

      Some states include sales of digital products and some don't. You should sit down with a CPA to get a handle on what each state includes and put together a plan for collecting and remitting the tax to each state, where appropriate. I imagine we'll see automated online programs that will handle much of this before soon if they aren't already available.

      The companies will almost certainly need to comply with the CCPA. The law does not apply to smaller companies pursuant to a three-part test, but Netflix and Hulu will be of sufficient size that they will need to comply.     How are these State Privacy laws affecting small businesses so far? Just curious since GA isn't listed on the list of States that have adopted new privacy laws.

      In theory, small businesses should be working to comply with the relevant laws of each state. Back in the real world, few small businesses are taking such comprehensive steps because of the time and financial burden. Nevada's new amendment goes into effect on October 1, 2019, and the new California law hits on January 1, 2020. Small businesses will likely start responding once California and Nevada issue newsworthy fines. What we really need is a national privacy law so we have one set of rules. Momentum is growing for one, but it is unclear when such legislation would be passed and signed into law. One would hope in 2020, but it is an election year with all that entails.

As data breaches in so many of our day to day areas of life (healthcare, financial institutions) continue to occur; one would hope that the federal government takes action sooner than later.     So if someone is just starting out and selling digital art that people can print out themselves I still need insurance for that? I have to put all this up front and insure my website plus the double sales tax issues going? Why even bother? All I wanted was to sell my artwork. My god this country has gone to crap.

      Insurance isn't mandatory; it is just a very good idea if the you-know-what hits the fan. But, yes, the taxes and regulations in this country are crap.

    What about those of us who do way more than 200 transactions with smaller digital items. Like I sell sticker packs really cheap. The amount of money I get from 200 transactions is negligible. And not worth hiring a CPA over. So the burden falls to us to track down tax laws from every customer. By the time I do one, I sold 3 more. This needs to change.

      It will be X number of transactions in a particular state, not 200 for the entire country, which hopefully creates less of a burden for you. Each state will set a different number of transactions. The Supreme Court spoke more in relation to burdens being put on small businesses versus a set number of transactions, so we should see years of litigation over how many transactions a state can designate. Not the answer you are probably looking for, but this appears to be the current situation.

      Camellia Squires Not to a great extent - the duty of care proposed will likely be implemented on a “proportionality basis”. The actions expected of an online intermediary will vary according to the resources (size) of the company, as well as the scale of the harm (e.g number of users reached, etc.). Accordingly, it shouldn’t really pose too much of an issue to small sites, although nothing is final yet.
