Mainly 2 issues but can have sub issues under that
Ma'am, what will be the 'ratio decidendi' of this case note?
Think about the 3 conditions that was used to define the word plying for hire. Form the ratio accordingly. If you give a try I will help
@@lawwithwaruni i really appreciate your efforts and thank you vv much for your time, Ma'am, in my knowledge I can recall two stage test laid down in Cogley v Sherwood *exhibition *solicitation of customers, and the third reason by Flaux LJ 'Character of the waiting' .. please correct me if i'm wrong and guide me little bit i need to submit my case note within this week :)) Thank you again
Niw that is the test laid down from Cogley but this case uses that for an app and with the concurrent judgement 3 parts identified. Did the case satisfied exhibition? If yes or no state the reason for it. Did the case satisfied solicitation? If yes or no give the reason Did pre booking exist here? Yes or no state the reason. Now think of formulating the ratio. Hi madam! I have a question. If I am writing a criminal case note, how the wording for the parties would be? Is that: Appellant: (Name of the appellant) ; Respondent: R (Regina), or I put prosecution instead?
Parties of the criminal case are, Prosecutor and Defendant. Prosecutor is always the state so R (Rex or Regina will file the case), Defendant is the accused
