    the way ive seen it explained is its easier to get a higher raiting based off the new grading system. its specific to citeria to different categories. if you get a LOI and pick which HLR grading system you have them usem. if you got underrated throw it in with the new grading system. Pretty sure they wont downgrade you.

    A veteran is not “safe” or grandfathered in when it comes to sleep apnea. 38 CFR § 3.951 (a) The regulation does provide protection against reductions solely due to a change in the Schedule for Rating Disabilities, but it also allows for reductions if MEDICAL EVIDENCE shows that the condition has actually improved. PL 102-86 and 38 CFR 3.952 provide protection against rating reductions solely due to changes in the rating schedule. These laws aim to safeguard veterans from having their ratings reduced just because the criteria for a rating have changed after a certain date (August 13, 1991, for PL 102-86 or April 1, 1946, for 38 CFR 3.952). These laws would protect a veteran from a schedule change-based reduction. If sleep apnea rating criteria were changed after a veteran’s rating was established, the VA couldn’t reduce the rating based on those schedule changes ALONE. 38 CFR § 3.951: states that disability ratings are protected unless there's medical evidence showing actual improvement. If a veteran’s CPAP data demonstrates “significant improvement” in their sleep apnea, it can be considered valid medical evidence of improvement, justifying a reduction in the disability rating. If the CPAP data shows medical evidence of improvement in the condition, the VA is within its rights to reduce the disability rating. The protection offered under PL 102-86 and 38 CFR 3.952 applies only to changes in the rating schedule, not to medical re-evaluations or improvements in the condition itself. 38 CFR § 3.951 explicitly state that the only basis for reducing a rating that was in effect at the time of a rating schedule change is clear medical evidence of actual improvement, which can be shown by CPAP machine data. The "grandfathering" protection in PL 102-86 and 38 CFR 3.952 does not prevent a reduction based on medical improvement, only schedule changes. Medical evidence (like CPAP data) demonstrating improvement can legally be used to reduce a disability rating under 38 CFR § 3.951(a). This is very troubling news for current service-connect veterans diagnosed with a 50% rating for sleep apnea and is prescribed a CPAP machine.

      @@KapRowley yes from the va to me . They are proposing to sever my compensation for hearing loss and titnitus effective 1/1/25 . I work closely with the Baltimore region office . But they can be difficult to communicate with at times

      Yes, unfortunately that's the case with many. They've increased workloads and have stricter timelines since the PACT Act deadline. Keep following up and going to your doctor to update them on your symptoms. The more paperwork, the better for you.

      For the most part you’re correct. I see a lot of veterans chasing SMC-S, and it comes down to if it’s worth it. For me it’s not, and I don’t plan on filing for anything else unless I need aid & attendance.

      Yes, you can get more than 100 percent. Once you hit 100 percent you then have to file for SMC. SMC is special monthly compensation. The kicker is if you have 100 percent chances are if you look hard enough at the different SMC's you can qualify to get a SMC rating and get paid more. 100 percent is not the stopping point. It's just a separate filing after 100 percent.

    Know this, if any veteran has been awarded the 100% P&T "and" said veteran goes back and applies for an additional benefit some number of years down the road. Said veteran opens their original claims back up for review! The same could apply to a vet with an 80% rating, reapply and you could loose! Yes that's right, some of your symptoms may have eased up and during reevaluation you could very well loose your P&T status not to mention getting knocked back down to 80 or even 50%. So think twice or maybe thrice before going after some of these newly accepted claims, like burn pit exposure becuase you could end up on the short end of the stick! Duty Honor Country SSG-GMAN

    I am at 10% tinnitus right now. I am also at 70% PTSD with anxiety and depression. My tinnitus gets really bad during my episodes of anxiety and depression with tension headaches. It gets to the point where the ringing gets louder and my ear drums beat really loud as if my heart was in my ears. I actually went to see my PCP at the VA 2 weeks ago because my tensions headaches would not go away for 2 weeks straight and I mentioned my tinnitus getting worse every time I get the episodes of anxiety and depression. HOW MANY TIMES AM I SUPPOSE TO GO TO MY VA PCP IN ORDER TO SUBMIT FOR A HIGHER RATING FOR MY TINNITUS???

      There are no higher ratings for tinnitus. Submit secondary to tinnitus for headaches. You'll need a diagnosis and a nexus letter connecting your tinnitus to your headaches.

    THANK YOU! Thank you so much for this. I’ve been rated 100% non p&t for a lung condition that I won on appeal - it took five years but I did win. However, I’ve been denied ssdi over and over and just last week talked to a SSA adjudicator that was asking for evidence that might help get me approved and what he needed was something showing how I was found disabled in the first place. Since this isn’t typically part of our va medical records, I sent him the code sheet from both PEB and the appeal. He sounded hopeful so fingers crossed! I also sent this code sheet with my application for CSRC. It was accepted and is now being reviewed. I don’t realize that it shows whether your conditions were considered combat related!!

    This is the problem. I personally spent my career avoiding medical care because it made soldiers look bad during my time. 93-17. Some of my injuries were in my record but most were not. Until 2010 or so any mental health complaint would get your security clearance suspended. Now I’m fighting to survive on just my pension because I’m old and conditions worsen. It’s a total goat fuck

      People are less likely to click on the video in our over sensationalized world that we live in. Most people aren't reading through the regulations. If that were so, there would be a lot more successful veterans. I'm trying to bring light to these regulations.     I was rated at 53 years with all my conditions being “static”. However, there are people I speak to that says the VA could re-examine me even after the so-called 55 years. It’s all confusing and if true, the term “P&T” is a monomer. Great advice and any comment on my comment is appreciated in advance. APTTMHY

      yes, the VA can still reexamine you after 55 and with P&T. Most times, it's unwarranted unless they are trying to prove fraud. I created a video that covers what to do if it happens.

      If you ask for it, they have to give it to you, by law. They won't let you know that, they're going to sideline you, at least try to, but in the end they have to. Look at HIPPA laws.

      The simple answer is yes, make sure to look up the 38 CFR for PTSD to get an idea of what worse looks like in their definition.

    Thank you for this information. I am a few years away from 55 (currently just turned 53) and was recently granted service connection today at 100% P%T. It states in the letter that it was 100% effective Jan 31, 2024. I think I just crossed the finish line. That is outside of unusual circumstances. APTTMHY

      You should be good, but unfortunately you can still have a reexam. The VA has been known for giving unwarranted reexams here and there. I made a video about that and what you can do if you get in the situation. It's called "VA Forcing Unwarranted Reexams"

    So while reducing unnecessary C&P exams, the VBA could insure more veterans could be getting their claims adjudicated quicker by C&P examiners that could complete the required C&P exams. Wouldn’t that be a great thing? Good video thanks for sharing.
