Conveying Minerals v. Conveying Royalties (Oil & Gas 18.1)
It is always important and sometimes very difficult to tell whether parties intended to convey a fractional interest in the minerals or a fractional non-participating royalty interest.
Sometimes parties intend to convey a customized interest that may differ from an archetypal mineral interest or non-participating royalty.
And sometimes parties intend to convey a fraction of the royalty that will later be paid on a lease which can raise questions about what kinds of lessor compensation count as a royalty. This video explores all these issues.

Division Orders (Oil & Gas 17.2)

The Implied Covenant to Protect Against Drainage (Oil & Gas 16.2)

Under the typical oil and gas lease, the bulk of a landowner's compensation comes from the payment of royalty so courts have intepreted leases to imply promises or "covenants" to help the landowner receive sufficient royalty. One important implied covenant is the implied covenant to protect against drainage. This implied covenant can be particularly tricky for oil and gas companies when they ha...

    This graph clearly shows that the percentage of renewable energy actually (marginally) declines from 2030 to 2050. However, the majority of energy in 2030 and 2050, some 77%, is still fossil fuel.

    I found out that a major energy and oil company has been producing oil from my land for 12 years now without my consent or knowledge. I have never signed or agreed to anything!! When I spoke with the energy company they let me know that there are no royalties or anything set to the side and that they are legally allowed to produce from my land. If this is the case. Do I have options? Can I go to a seperate Oil and energy company to actually lease from my land instead of being taken advantage of by the current energy company?

    Is depreciation double counted in the revenue requirement formula?

    • @energylawprof
      @energylawprof ปีที่แล้ว

      Not really - It’s subtracted from the previous year’s rate base to get the current year, but you get to recover the depreciation (the fall in value of your capital assets) as an operating expense. (So it’s subtracted in one part-that gets multiplied by rate of return-and added in another.)
