UNCLOS provisions were not written to resolve competing claims of sovereignty. UNCLOS provisions about EEZ assume all claims of sovereignty have been settled. Filipinos need to wake up and accept that none of the five permanent members of the UN Security Council have ever accepted any international court's ruling when it infringed their sovereignty or national security interests. The UK & US blatantly continue to defy both the UN and ICJ rulings that affirm Mauritius’ sovereignty over Diego Garcia (which the UK took by force). The overwhelming majority of sovereignty disputes were settled by military/ economic might or diplomatic negotiations. Only a small number settled by arbitration. Arbitration is only possible if BOTH parties consent to it. US, Australia and NATO interests do not align with Philippines or regional countries’ interests; they do not live in the region next to China. Western blood is too precious to spill for Filipino territorial ambitions. Beware of the American Military Industrial Complex bearing debt trap gifts. The world is littered with regions (eg Middle East) and countries (eg Ukraine) ravaged by proxy wars and conflict. Filipinos need to learn self-sufficiency. Spending 1% of GDP on defence is inadequate. Filipinos need to hold their government to account for the amount of corruption or incompetence in their naval procurement programs. Austal is one of the current contractors for new coastguard vessels. Austal has just been fined 24 million by the American DoJ for corruption. Go figure. That is why Filipinos haven’t got proper equipment to defend what they want to claim. Filipino leaders need courage and leadership to ignore populist nationalism and pursue effective solutions. Quiet diplomacy pursuing conciliation (eg Iceland and Norway) or joint development agreements of cooperation (eg Malaysia & Thailand in Gulf of Thailand gas fields). China does not lack political wisdom. In 1980, Deng Xiao Peng innovatively advocated “shelving differences and seeking joint development” to resolve territorial disputes with other countries. A policy that China still advocates for. Parties involved can choose to agree to disagree about the disputed territory and shelve their competing sovereignty claims first. This does not mean giving up sovereignty, but simply putting the dispute aside for the time being so fishermen can fish in peace and allow joint development of oil and gas fields like Malaysia and Thailand have. A share of something is better than nothing at all.

I highly recommend all true patriots and pro-Filipino to share this video with the widest possible audience. The Filipino people should be forever thankful to ex-President Benigno Simeon Aquino III for his administration's assembly of the best International Law minds and scholars to assemble the case to the ITLOS (International Tribunal of the Laws of the Seas). The Philippines has won the victory not only for itself, but for the whole world that there should be a freedom of navigation of the seas. This is a legacy of PNoy to Philippine history.

my 2 hands are raised up with fingers jointed together to the tip of my eyebrows and jointly salutes you, SC Senior Associate Justice Antonio Tirol Carpio, for this lecture of yours about DEFENDING PHILIPPINE SOVEREIGN RIGHTS IN THE WEST PHILIPPINE SEA. There are now 5.4 comments your lecture. Please count me in, it's +1. Our new Secretary of Education must find ways and means so that this piece of our sovereign right, let alone being a parcel of our history, be incessantly and leveling-up taught to our pupils in the elementary schools and students in the secondary and tertiary schools. Moreover, the same Secretary of Education must endeavor to require all classrooms to be displayed with that faithful reproduction of the original map of the country, the PEDRO MURILLO VELARDE MAP which was printed in 1734.

Filipinos, please stop lying and check the Treaty of Paris of 1898, which clearly stipulates that the westernmost part of the Philippine Islands can only reach 118 degrees east longitude. All of China's islands and reefs in the South China Sea, including Huangyan Island, are located west of the 118th longitude east.
