Hey Luke! I’m sure you know I love these videos but I need to know how you handle cases that are written to be extremely complex. For example, Colorado’s People v. Snow is based on the real-life Karen Read trial, making the case exceptionally difficult to untangle and optimize theory. I’ve read several Tennessee cases (above-average in simplicity) as well as cases from most other states, and none seem to rival the complexity of Coloradan mock trial. Help?

Hello - mock trial witness here: I picked up that you participated in and coached mock trial several times - in your mock trial competitions, did/do you have set timing rules for cross and directs etc.? If so, as a witness, since it's a viable option to chew out opposing cross attorneys' clock (right?), how would you go about doing that? (I don't know if you have a video on this or not.) Is it just elaborating on many things, or something else?
The competition will have timing constraints that you'll have to follow! It's not a bad idea to try to eat some of your opponents' time, but you never want to "filibuster" by just droning on and on without a purpose. Keep your explanations responsive and helpful 👍🏻

Correct. And that's the winning formula for cross.
I am a Mock Trial coach (and did Mock Trial in college and law school) and I frequently show your videos to my team. They are helpful. I also frequently judge college and law school mock trials. I have to give my 2 cents because I disagree with you here, even though I agree with your last point on doing a redirect to clear up confusion on cross. First, in mock trials, judges are judging advocacy and attorneys' knowledge of techniques, and not actual merits. If a witness is torn apart on the stand and the witness's attorney does not at least try to rehabilitate them, that is a minus for me. I would wonder if the attorney is too scared to stand back up to rehabilitate and if they don't trust their witness anymore. I also would wonder if the attorney was not taught to do a redirect. Now, if the witness is impeached, depending on what the context was for the impeachment, the student may not want to address it on redirect as it only emphasizes that the witness was impeached. Second, I am not sure about having a planned redirect regardless of what happens on cross. Redirects must be within the scope of the cross. Although, yes, you can predict most points on cross, you cannot know for sure. For planned directs (I have never ever coached my students to do one), the student must know NOT to do it if any points were not raised on cross. Otherwise, they will draw an outside the scope on cross objection. Also, with a planned direct, you have to be careful that it is not a regurgitation of anything asked on direct. Nevertheless, your video has given me some food for thought. Thank you!
Could we have a video about rule 608 of the Rules of Evidence : "A Witness’s Character for Truthfulness or Untruthfulness" and when should we object to that. I have been objected to that before in a competition and the rule seems very complicated. Thanks

Do we need a school sponsor to do mock trail? I want to do mock trail, but my school does not offer it. Would I have to get a sponsor and put a team together with the school, or is there any way I can do it outside of my school?
Depends on the rules for your state's program! I'd do a Google search to figure out which organization manages high school mock trial in your state.

Hey, love your videos but this can be somewhat misleading. Improper impeachment could also apply to a criminal conviction that doesn’t meet the standard in FRE 609

@@ultimateuthman680 To leading? I’ve honestly never seen that happen or even thought about it with those questions 😂 I guess I’d just tell the judge those questions are necessary to develop the witness’s testimony, which satisfies Rule 611.

So what if, for example, I’m on defense and Person A and Person B are on plaintiff. In Person A’s affidavit, they talk about something Person B says. When I’m crossing Person A, could I bring up the thing that Person B said?
Depends on the context. Witnesses in mock trial are only bound by their own affidavit, but sometimes you can bring up others. Also depends on how you phrase the question. "So if someone takes the stand later and says something else, they're just lying?" is a fair question. "But Person B says _____," is not. That's actually hearsay.

EvEvidence hearings
On the teaching end, what order do you teach in when starting out with a new group of students who haven't done this before? I'm teaching a mock trial class in our classical homeschool community, and I'm struggling with where to go after the first class where I introduce mock trial's purpose, the players, the flow, etc. In the second class, I may assign roles and start into more details of what everyone will be doing in trial. We have 15 weeks of class. How long do you usually take to prepare everyone?
Great topic idea! I'll definitely cover that in a future video. For now, I'll say that I always start by teaching the five parts of a trial and making sure everyone understands the fundamentals. Then, I move into witness performances and objections/the Rules of Evidence.

Hey Luke! Great videos, as always. Can you do a video on the badgering/argumentative objection? As I understand, it is when the opposing counsel tries to get the witness to agree with a conclusion. However, as I don't see this objection too much, is it worth making? On the other hand, what constitutes as badgering? Interrupting the witness, shouting?

I love being character witnesses. I’m a pretty good witness, and my coaches have tried to convince me to try being an expert or attorney, but nothing in this world is more fun than being a little crazy while still subtly helping your side of the case. Great video!

@@jubilibw2366 Usually no. Officers are typically just there to share the facts they know. Occasionally, an investigator will have a specific area of expertise like accident reconstruction that warrants treating them like an expert. It’s not the norm, though.
