Redundancy Protection on Maternity Leave
A recent case that analysed the law in regards to redundancy protection when on maternity leave.

      If someone has provided you with a statement and then changes their mind, it is important to understand their reason for the change and see if you can reassure them about the process so that they will come to the hearing and be a witness. If you cannot persuade them to change their mind and you have a written statement from them already, then you may consider applying to the Tribunal for a witness order that would compel them to attend. You can ask for a witness order even if they have not already provided a statement, however without their evidence in writing it can be risky as you do not know what they will say at the hearing.

    what happens if a judge fails to acknowledge that even though the respondents submitted a responce they have not acknowledged the actual claims ,is it true there debarred from then defending the claims they ignored either intentionly or by omsion cause that happened to me n i pointed it out to chairman now judge that she was wrong n the case management notes exclude my isseus i raised n discussed , n portray an abject bias ,the tribunal bullied me by phycological bias covering up my 2 cases where the exposing to me the tribunal judge n respondents solictor are colluding n perverting the course of justice ,those events events forced me accept 25grand to go away but that cot3 was not legally sound on many points either ,lets chat

    By law, employees don't have to disclose, and yes, they still discriminate. Even if you disclose, you don't have to disclose diagnoses!

    My case is one of unpaid notice pay. I engaged with ACAS early conciliation process and got a very vague offer to settle before tribunal. I asked what they proposed to pay and nearly a fortnight later we have heard nothing from them. Now ACAS have given me my ECC as the ACAS clock has run down. Now, I have two questions; Am I able to deal directly with my ex-employer now, without prejudice to my case and if I am forced to tribunal, am able to claim my legal costs and compensation for the stress and financial inconvenience I have suffered?

      Hi for parental leave eligibility is as follows: you must have been with the company for more than a year; named on the child’s birth or adoption certificate or have or expect to have parental responsibility for the child; not self-employed or a ‘worker’, for example an agency worker or contractor; not a foster parent (unless they’ve secured parental responsibility through the courts); the child is under 18. Parental leave is different to paternity leave. Parental leave is unpaid leave and is up to 18 weeks’ leave for each child and adopted child, up to their 18th birthday.

      If the employer is not responding to your correspondence it is worth seeking some advice as to your next steps and if you have a potential claim for constructive unfair dismissal.

    Is it allowed to be suspended but still be expected to report to work daily to help in other departments? I was suspended from my duties since the 4th of June and I was interrogated several times by different people. Then I attended a disciplinery hearing on the 30th of July of which I only received outcome of the hearing today the 9th of September and I was demoted

      I am sorry to hear what has happened. In terms of the suspension and requirement to work in other departments, this is likely to be a reasonable requirement whilst they investigated the issues. However it will depend on the nature of your work and what you were being asked to do outside of your normal job role.

    Hi i have been suspended for 2 years now. The investigation panel had submitted its report to management almost a year ago. I have been employed with them for almost 17 years. . It has become apparent that the employer is personalizing its stance against me. I work in the government in one of the pacific island countries and my employer has constitutional powers to hire, fire. Could you please advise what i should do

    Hi, as the law has changed on how part time workers or zero hours contracts, if you are contracted for one day a week you are entitled to 5.6 days holiday. But with the changes, if you are asked to work more days how do you calculate these extra days to benefit either with extra days holiday or payment.

    Can one work an agency job during maternity leave, whilst recieving maternity leave pay.. when working for the NHS? How would this affect one's tax deductions and allowance?? Is it legal and are they loop holes?

      Doing work for another employer or doing casual agency work will not normally bring the maternity leave with the substantive employer (NHS) to an end. Th employee needs to ensure that they check their contract as they may have to notify and/or obtain permission from the substantive employer before starting work elsewhere. The position on statutory maternity pay (SMP) depends on whether the employee was working for the agency at the 15th week before the baby was due. If they were then SMP with the other employer (NHS) continues. If this is new employment then SMP with the NHS would stop when she starts the new job. The position with enhanced contractual or discretionary maternity pay from the NHS may be different and may still be paid, depending on the rules of the scheme.

    The General Manager forces me to come back at 1am and 3am to closed the restaurant because i did request for a day off when i was invited to attend a celebration from my former manager and the General Manager force me to return to the company to closed the restaurant at 1am and 3am plus i tried to to day no because i have to travel from far place she still didn't care

    This is my first time being suspended from a job and I work with people who have mental disabilities and someone is claiming I abused them when I give the utmost care to the clients. But the supervisors cannot say who or what it was but I will only get paid 5 days and after that just have to wait to hear back but never in my life 😞

    Hi Alison - I'm a claimant. Should I be preparing a 'final statement' which sums up everything? Nobody really mentions this online so I'm unsure. My witness statement has a strong conclusion, but am I right that there's an opportunity for each party to summarise their case? And if yes, is this read out by each party or submitted in writing like the witness statements? Thanks!
