In relation to education setting: as duty bearers, extraordinary care of diligence is highly expected from teachers and school administrators, who have special parental authority and responsibility in dealing with their learners/students. This legal principle requires the diligence of a good father of the family in ensuring that learners/students shall not be harmed or abused in the schools; ultimately promoting the best interests of the learners/students.
Legal basis:
1. 1987 Philippine Constitution;
2. Republic Act 7610, Special Protection of Children against Abuse, Exploitation and Discrimination Act;
3. Article 218 of the Family Code of the Philippines;
4. Article 2180 of the Civil Code of the Philippines;
5. Presidential Decree 603, Child and Youth Welfare Code;
6. Child Protection Policies of the Department of Education; and
7. United Nations Convention on the Rights of the Child.

Ask ko sana Sir, Paano kung ang mga nabully na students ay nagbitaw ng salita na kung hindi maaalis ang batang nambully ay sila yung aalis. Ang school ay need idaan lahat sa due process, ang school ang kawawa at yung student na nabully. Paano ba matutulungan sila?
@@adventistschools5138 hello po, I assume this inquiry is for private schools. For transfer of students under your care, pls be guided by sections 127-128 of DepEd Order No. 88, s. 2010, as amended. For other matters, a private school operating basic education services has its own school manual of regulations, which includes intervention program/s for students (offender or victim). Private schools in DepEd CALABARZON are highly encouraged to adopt the Guidelines stated in RM 217, s. 2021. Thank you and Godbless!

Sir, Hello po. Nagwowork po ako sa isang public school here in Biñan, Laguna. 45 teachers po kami lahat at karamihan po ay season teachers. Is there a chance you could come by to talk about CPP? Gusto ko po sana bigyan ito ng ngipin among ourselves by looking it into the side of law. Hello po ma'am Nikki, magsubmit lng po ng letter-complaint sa school kung saan nag-aaral ang anak nyo (thru school principal). Sa letter-complaint, ilagay ang mga detalye (name of student at Grade level, name of class adviser/teacher at mga ginawa nyang pang-aabuso, contact number at email po ninyo). Ang school principal ang mag indorse/forward ng complaint sa Regional Office thru Intake Sheet. Meron pong designated DepEd investigator na magconduct ng fact-finding investigation at kayo po at ng anak nyo ay imbitado sa nasabing imbestigasyon. Salamat po.

paano po kung ang mismong Guidance Coordinator/Counselor ay nakapagsalita ng hindi maganda sa mga bata o s batang nag-violated ng rules..? May karapatan din po b ang batang nagkasala n makapagpaliwanag kung bakit niya iyon nagawa.?
Hello po ma'am, as to your query sa conduct ng Guidance Coordinator/Counselor, if ever po na may alleged verbal abuse na ginawa sa ating student, pwede din po na madisiplina ang ating Guidance Coordinator/Counselor. Mangyare lng po na ireport ito sa ating school head/principal para magawan din po ng Intake Sheet at kaukulang aksyon. Sa karapatan naman po ng batang bully o nagviolate ng school rules/policy, nasasaad din po sa deped rules na meron din syang right to due process (opportunity to be heard and explain his/her side). Ang karapatan ng isang student ay nasa Student Discipline Manual/Procedure. Malinaw po ito sa ating discussion sa ating recorded video. Maraming salamat po.
