Selling a House in a Divorce | What to know for a Smoother Sale
In this video, we will cover the process of selling a house during a divorce.
On today’s show, I have Holly McClung. Holly is a certified Divorce Real Estate Expert.
I wanted to bring Holly in on this series we are doing around real estate and divorce because, as a tenured Realtor and going through the process of getting certified as a Divorce Real Estate Expert, Holly has insight into the complexities of selling a home during this time where there can be a lot of emotion and complex hurdles to overcome..
Before we dive into today's episode, I want to take a moment to address the gravity of our topic. Divorce is a deeply personal and often challenging experience, and we want to approach it with the utmost sensitivity and respect. Our aim is not to trivialize or make light of the emotions involved, nor do we seek to encourage anyone to undertake this process lightly.
Instead, we recognize that divorce is a reality for many individuals, and it can often involve complex real estate transactions. Our series is intended to provide guidance and support to those navigating this difficult journey, offering practical insights to help avoid common pitfalls and make informed decisions.
We want to emphasize that our intention is to be a valuable resource, not to exploit or sensationalize the difficulties of divorce. Our goal is to offer clarity and support during what can be a confusing and emotionally charged time. Thank you for joining us on this journey, and we hope that our content proves helpful and informative to those who may need it.
We are not licensed real estate attorneys or family law attorneys. Any advice or recommendations shared in this series are based on research and experience, but they should not be considered as a substitute for professional legal counsel. Great video very informative! I do have a question myself. We bought Oct 2022 and on 2023 filed for protest but didnt know much about protesting as a first time home buyer I didnt use my closing statement to bring the appraisal down to sales price. I still got a reduction but still far from sales price that year. This year can I use my closing docs and request to bring it closer to our sale price since last year I sort of over paid?

      I would bring it and explain that you weren't aware this could've been used as support in your last hearing. I'm not sure they'll use it but I always recommend people bring any evidence they possibly can. However, that closing statement is now for 2022 values. The appraisal district is looking for a value as of January 1, 2024. Where your 2022 closing statement might help is if you had been able to get your assessed value lowered to your purchase price for 2023, then your 10% cap would be lower this year.

    Extremely insightful. A similar scenario happened to my lady and I when we first purchased but our loan officer had advised us about this “lil” expensive hiccup. Our realtor was “trash”… we did ask if she had experience on “new builds” of course she said yes. Meanwhile non of this and many other things was she aware of. Thankfully we were able to “prepare” for it since our loan officer had advised us. These are the things that set the good from the greats in real estate. Thank you for the insight 🙌🏾

      Good idea on the mirror. Many would tell you to remove any religious items but I focus more on minimizing the number of items as opposed to what they are. I'm protesting my taxes now, had the informal hearing since my market value went up nearly 250K (despite me having my homestead exemption). Apparently the metal awning I put up for a carport, the metal shed for my mower, and metal building I put up for to use as my workshop is why according to the county my taxes went up. With a total cost of around 20K for the buildings, I have no idea how the county is coming up with an increase of nearly 10x what it cost for them. At the informal hearing the county said I was assessed correctly due to the new structures. It's going to be interesting to see how the formal hearing goes.

    Great video. I am just sick and tired of fighting appeals to afford taxes and insurance on a home I have already paid for. Found out this year there are no comps in my subdivision to compare to. While Market value to sell is ok. I shouldn't be paying taxes on something I am NOT selling. Mine went up $118k this year. Not good on low income. I also hate that on the DCAD website total is estimated taxes instead of actual tax. So much for transparency.

    Is the appraised value the same as the assessed value?

    • @livingindallasfortworth
      @livingindallasfortworth หลายเดือนก่อน

      Not always. The appraised value is also called the market value of your home. That's the value the appraisal district has placed on your home based on market data. The assessed value is what you are getting taxed on. So if you have exemptions and/or an appraisal increase cap, then your assessed value would be less than your appraised value.

    • @SuchaCaligrrl
      @SuchaCaligrrl หลายเดือนก่อน

      @livingindallasfortworth 😳🤪... I'm looking at my tax notice, and the appraised value is different from the market value. What makes this all confusing is that you're using words that do not show up on the tax form notice so people are like "wait, where is the "assessed value". All we see are 2 line items: 1. Market Value and 2. Appraised Value. So to clarify the Appraised Value is the Assessed Value?

    • @livingindallasfortworth
      @livingindallasfortworth หลายเดือนก่อน

      @@SuchaCaligrrl The notice of appraised value looks different from each appraisal district. Great video and very useful information! I'm a licensed real estate broker in Texas and a registered Property Tax Consultant but I feel it's harder and harder to protest property tax these years unless the property did suffer a big loss or being damaged. One of the difficulties we are facing right now is that the county's adjustments to the comps are sometimes non-sense... For example, the CAD adjusts big $ amount on very small sqft differences of patios, garage spaces, decks, etc. not to mention their time/market adjustment. Anyway, thanks for the information you provided!

      Assessed value is the same as the appraised capped value and this is the amount you're getting taxed on. While many of the suggestions you make are very helpful and I can see why they have the potential to boost the chances of selling the property a little faster. However, some of the tips seem to take the process a bit too far, such as expecting homeowners to “change out their drapes” if their drapes have color other than a bland neutral or a pattern of some kind. Even the most opinionated and critical of buyers can comprehend that not everyone has the same taste in decor, and expecting homeowners to discard their expensive patterned or colored drapes for bland, nondescriptive one isn’t a reasonable expectation and may be taking it too far for the seller. If the seller’s home is being featured in House Beautiful, Architectural Digest, or other elite home publications, then perhaps going to the expense of doing all the things you have outlined would prove advantageous. Otherwise it could be costly with little to no chance of recouping the associated expenses. Again, your tips are great, I’m just pointing out that some of them come with significant expense in both money and time which defeats selling the property faster, with no assurance the seller will be able to recoup the added expense or sell the property at a higher price than what it already appraised at.

      Thanks for your comment. The goal of staging is to do all you can to make your home appeal to the widest possible audience and these suggestions are for a general audience. It's why I recommend connecting to a local expert to get specific guidance on what works best in your market by visiting topagent.thehomestagingguide.com/ In luxury properties, we do sometimes make exceptions to the suggestion on drapes if they're a compelling element to the overall design of the house. In our market, drapes and curtains sell with the property unless specifically excluded by the seller on the purchase contract. When those can cost thousands of dollars in certain homes, they can be an asset as opposed to a hindrance.

      Neutral beige or cream drapes, or just white sheers, are more about neutralizing your decor and not turning off buyers who don’t share your specific taste. These are not going to be costly investments, they needn’t be luxurious or bespoke. The point here is to eliminate colors and patterns that are taste specific, and keep it neutral, to achieve mass appeal. The more interested buyers you attract, the more offers you will receive, maybe even a bidding war. Spend a few dollars now to make lots more profit later. I’ve been in the industry since 1985 and ALL of her advice in this video is spot on.

      Hi there! When I made this video I had over 300 requests for comps. I honored the requests from last year, when I made the video, but this year had to close the request form this year and only offer them to past clients who have bought and sold homes with me. To help out this year, here’s a guide I made to help with the process: www.jennifer-shannon.com/compsfortaxes

    Great video, Jennifer, thank you! Even better than last year's. Do you know of any case where DCAD actually gave a tax value reduction for "physical, functional, or economic obsolescence"?

      ha - thank you! I am not aware of that but I definitely think it would be worth trying!

    You effectively can't protest unless your market value is less than assessed value. For me (and probably in general), this means that unless your appraisal is off by more than about 24% then you won't win a protest. To win, your home would need to have suffered significant damage of some kind--not simply an assessment "mistake". Taxes are theft. Property taxes are the worst kind of tax since they target unrealized gains effectively making all Texas home "owners" simply renters to the state. Property taxes are directly correlated with inflation but your wages are not. This leads to people getting taxed out of their home over time. But at least we get multimillion dollar stadiums for high-school football. Protest impotently if you like, but it's pointless for most people. The assessment figure is not the problem--the tax law is the problem.
