Where is GST DRC 03 a in portal
The same issue has occurred to us as a TDS amount of 1 lakh rupees was deducted u/s 194N but not get reflected in my 26AS form. We were not aware about this hectic scenario and opportunities explained by you hence we filed ITR just around my 26AS form and the amount which is not showing in 26AS form is till unclaimed. So what to do revised return or grievance regarding this issue to ITD? Respected sir please guide us...

@pathkris2984 the govt has clarified with CBDT today evening that only if major loans are defaulted and heavy amount of taxes are due or undertaking are given for payment of taxes, then only income tax clearance certificate will be required. Not all citizens
Sir in that illustration point 7 case a) if TDR is not utilized in the same plot then the buildable floor area on plot should be 400 x 1.5 = 600 sq mtrs right ? as we have surrendered 100 or will it be 750 only can you please confirm
sir if an amount of 1 lac rupees on oct 2024 is deducted from my current account of SBI on the behalf of 194N but not showing in my 26AS form. On the other hand the bank manager is procrastinating the overall matter with different excuses. what are the further steps we can avail to claim the amount?
First take a written acknowledged copy of the TDS challan which bank must have paid in November to 2023 . Check your PAN details in it whether deducted or not. If the manager still doesn't accept complain officially to bank and RBI ombudsman.
Do it fast as due date for filing ITR is approaching
Also check your AIS statement on IT portal.

As you have accepted the tab don't reply to verify and dont file updated ITR. Let the dept send a notice . Then reply with the correct data. Otherwise the FD interest Mismatch resolved on its own

Sir, i got this same message about interest from deposits which includes FD interest also.. the same is fully disclosed in ITR under Fd interest and other interest column..but here under difference column shown only fd interest income .. how to submit that reply..? Kindly guide. Thanks in advance

Income Tax Department has spotted mismatches in interest and dividend income data from third parties versus taxpayers' filed returns. An on-screen functionality has been made available in the Compliance portal to reconcile the mismatch. I have purchased a flat in second sale in 1992 from an investor via sale deed on Rs 100 stamp paper. He had purchased the flat directly from the builder in 1988 via sale deed on Rs 10 stamp paper. Do I need to apply for both these sale deeds. Also will stamp duty be calculated on both these sale deeds seperately, or will the stamp duty be clubbed to determine waiver of the stamp duty. Please get back.
You need to regularize the earlier sellers documents then only the title is legally clear . Then regularize yours as well which will make the title clear. Send me your mail id will send the presentation

Both separate as parties to the agreement are different.
@@cajoym7248 So the waiver limit of Rs 1,00,000 will be available to both these deeds independent of each other.

The Maharashtra state government has passed a bill allowing slum dwellers in Mumbai to sell their allotted flats within five years, benefiting approximately 2.5 lakh flat holders in the Slum Rehabilitation Authority (SRA) projects. Previously, slum dwellers were restricted from selling their SRA flats for 10 years. The decision to reduce this period gained momentum during the previous government but was ultimately approved by the current government.
If it's above 5 years go for it. 1st phase ends on 29th feb
Original sale deed paper is required for this scheme.

Sir I have a query: Apartment is on my mothers name, agreement to sale is registered duly in May 1999, and stamp duty is paid. But Assignment deed is not stamped/registered. It is done on Rs 50 Stamp Paper, in May 2000, in Sub registrar Haveli also the document is not stamped. We have Only the Xerox of Assignment deed, but we have certified copy of agreement to sale. Mother is demised and original owner is also demised. What is the correct process to proceed in our case?
The amnesty scheme is for flats purchased after 1980 what about the ones before that ?
As of now it's from 1980. In respect of deeds executed between January 1, 1980 and December 31, 2020, but not filed or registered, the entire stamp duty and penalty payable to the Revenue department will be exempted under the Abhay Scheme

Yes and if it was lost or mutilated or any damage, then a FIR copy or a true copy certified from Registrar office

And as you have bought it in 2022 already you must have paid entire stamp duty and registered. Otherwise in current scenario how will one get the ownership

first owner while purchasing flat(purchase value less than 5lac) from MHADA in 1999 has not paid any stamp Duty. MHADA handover the property on allotment letter. After some years he sold the property . At that time MHADA has not informed anything like this pending stamp duty. Second owner has paid all the stamp duty while purchasing the property in 2010 from first owner. Now society is planning for conveyence deed. But due to non payment of first transaction stamp duty the process is stuck. Now as per this amnesty scheme the second owner is beneficiary? Is there any documentation /application is required from second owner to get the benefit? To get the benefit what should he do? Requesting your reply.....

Find the value of 1995 as per stamp valution authority (SVA). Check the stamp duty applicable as on that date add with penalty upto now, then file for amnesty. The first phase is still on. And yes consult a advocate as documents are important. For Income Tax purposes capital gains tax is as per vakuaarrived at from 2001 so get this advised from advocate as well.

What if the stamp duty was paid at the time of purchase of flat but the registration was not done. Do we have to pay the stamp duty again as per current market rate?
An unregistered sale deed is not valid and the sale agreement is not a title document. Since you have already paid the stamp duty (how and when), you may request for waiver of stamp duty based on the stamp duty already paid. Whoever was your vendor, has to execute the registered sale deed in your name. The share certificate of society is not a title document. The new buyer cannot be held liable to pay the stamp duty, it is the duty of the original buyer to pay the stamp duty and the deed registered on his name. The new buyer cannot by the property without proper registered sale deed or title to the seller. ALSO CONSULT A ADVOCATE AND GET THE PROPER DOCUMENTATION DONE

What would be the stamp duty rate on a sale deed of flat in housing society executed in the year 1988?
You will have to first determine the Market value of the flat in the year 1988 as per the Ready Recknor value. Thereafter, the slapwise payment of stamp duty calcuation is done on the entire market value.
For any flat purchased in a co operative housing society on or after 10-12-1985, it is required to pay stamp duty on market value at the time of signing the agreement itself.
