Email the Agency Your Mandamus Complaint Even When It's Not Legally Required
Why We Email the Complaint, Even When It’s Not Legally Required
When a lawsuit is filed, the process of notifying the defendants that they have been sued - known as "service of process" - must follow strict rules, including personal or special delivery requirements. Until properly served, defendants are not obligated to respond to the lawsuit unless they waive this formal service process. Typically, a defendant has 20 days to respond, but the government gets 60 days.
We take these service requirements seriously and follow them meticulously. This means using the U.S. Postal Service to send the necessary documents by certified mail to the government agency’s designated physical address. Unfortunately, printing and mailing take time, even though we initiate the process immediately to ensure that the agency is formally obligated to respond as soon as possible.
In addition to publishing their physical postal addresses, many government agencies also publish an email address for receiving lawsuit-related correspondence. While simply emailing the lawsuit papers will not meet the legal requirements for service of process, we believe in taking extra steps to expedite the process. That’s why we send digital copies to these email addresses in addition to mailing the official paper documents.
This proactive measure ensures that the agency is aware of the lawsuit immediately, potentially speeding up their response - even before they’ve received the official papers. It's an extra step we take to advocate for efficiency and accountability.

    Interesting, is it Ok to just send email to the Chief Civil Division even though she is part of the senior leadership? their emails are not available on their website but of course you can find them on legal documents, it just feels weird to hunt down a senior leader email and send them courtesy copies.

    I recently read your book since I was thinking about pro se writ of mandamus, great book. I read about FOIA trick in there as well. I had two questions: 1) Is there any point in doing FOIA if doing pro se? does it increase the odds of getting costs paid by government as well? 2) Is there a strategy to maximize the chance that the case goes through (maybe by trying not to settle) and make the government pay the fees? if so what are the rough odds of that happening?

      I don't know if you can get attorneys fees if you file pro se. I know in other similar contexts, you cannot.

      My visa was refused under 221(g) back in October, 2019. They asked me some information regarding my addresses and travel history and after providing them it went to the administrative processing. I haven’t heard anything from them since November 2019. I wanted to visit to Las Vegas for a conference this December and finally decided to reach out to the embassy, they mentioned that administrative processing cases automatically closes after a year and you have to apply again. So I applied and have my appointment date of next year, July 2025 ( longer wait times ). I hope it helps :)

    For those struggling with the cost, DIY (pro se) filing is also a thing, there are enough online material to help with that. Requires some effort but it is doable. Again worse case would be nothing happens, or if there are court hearings (that means more prepping.). It would cost around 400$ to file the complaint.

    thanks for sharing, after waiting 4 years, I filed mandamus lawsuit on April, after we served the summons, the attorney complained the summon is not comforted, after I send amended one, they are justing dragging my case with no actions, now I received the letter from the court that informing me the case will be dismissed after filing 90 days with no any actions.     Is it possible filing Write of Mandamus if it has passed more than 120 days since I751 and N400 interview. I-751 filed in 10/7/2022 , N-400 filed 10/12/2023? Marriage based, 3 year rule. N-652 approval and pass was given at the day of the interview but then the same day was transferred to a different state and different jurisdiction USCIS office. Since then USCIS has given only notice about transferring i-751 in Missouri, but no updates for n-400. Senator, congressman, ombudsman, uscis(multiple times) have been contacted since interview. Can i file Mandamus for delay of the Oath if i-751 has not been approved yet due to being sent to a different office for processing for no reason?

    i am there , i was granted a pardon to get back my resident card , i lost it (i had since 1997) and was subject to removal because a 1998 felony robbery charge when i was 18. judge pardoned me in 2017. i am 44 now, just got denied my n400 and now have to appeal. so yes this has been my life for the last 12 years,. so its a $850 money ($1.3k down payment to the law office on Monday ) order payable to immigration NSCIS and $3,000 for my lawyer after paying $50k and recently $2k for the n400.

    Hello. My son has been in AP status since September 2023. My wife (stepmother)filed for him in 2019, and his interview came up on August 28th, 2023, main while before the interview date, me and wife had separated but not divorced, so he was refused the visa the visa officer asked my son if he was aware that there was a separation and he said no. The Embassy reached out to my wife with some questions and asked for documents and we supplied and requested documents since November 2023, up to date we've not heard anything from the Embassy, whenever I email them, they always say they are working on the case.
