I know this video is a few yrs old but I just opened my mail and a lawyer sent me one for my son so I figured I'd look it up. The appearance paper has him down as grandson. Should he be written down as heir? My mother in law passed 6yrs ago an my husband passed 5 and I'm just now hearing her house was only in her name and not her husbands an she left the house to my son (since my hubby passed it's now his I think?) Only problem is my mother in law never filed a will with the court and the husband and sis in law is hiding it. I'm not sure what to do but according to the paper they sent along with the appearance paper said we had to split even my husbands estate with the sis in law and father and I'm definitely not signing that. Sorry I'm rambling but my main question is should he be down as an heir or beneficiary or is grandson ok? I'm in Michigan also and I'm confused I'm getting it since he's 15. I thought this was for 14 or under?

I would also suggest that you get somebody who has a lot of experience dealing with guardianship court because that is horrendous and if they have that experience and they're honest and trustworthy that is a person that you want. Also when you are doing your estate planning make sure you have a highly experienced tax attorney that knows all about the taxes that are due during Estates and trust and powers of attorney. That can also be a huge bite in the butt

Okay real lawyer here. I always do my Powers of Attorney for property or health care so that they are durable in nature. All states in the US recognize a durable power of attorney. This means that the power of attorney expires at a date later than incompetency or death. In all of these documents it has a clause that says this is the expiration date. I always write in that it does not expire until and a state representative is appointed. Usually at the same time we are doing a will and I put in there that the power of attorney does not expire until an Executor is appointed. Why do I do this is because when somebody becomes incompetent or dies the bills still have to be paid, funeral arrangements need to be made and there are all sorts of things going on. So always insist upon a durable power of attorney. If it's a healthcare power of attorney or a living will that does not expire upon death it means that you're representative can make the funeral arrangements they can decide the funeral director and how the body is handled and the funeral service will be conducted. If it's a power of attorney over property that means the electric gas and water will be paid at your house. So this video isn't exactly correct I'm not sure who this guy is or what he's doing but there are so many other considerations in a state planning make sure you get someone who is highly qualified to do it for you
