Why are all the smartest people always show up to teach others about laws they’re everywhere seems they know everything about everything with these geniuses who needs books on law when you have people like her, go on ask her.
Filming someone in a truly public space such as a park or Church Street/downtown is one thing. Filming at a medical facility or other such institution is another and she is absolutely correct that filming or photographing someone there is a violation of HIPAA regulations and laws, which have to do with the privacy related to medical conditions/diagnoses, medical care, psych care and diagnoses, etc. I support what you do, in general, but this IS an area that you need to become more aware of/better educated about before there are serious legal repercussions. Not only can private individuals sue you, you can, indeed, as she stated, face fines and jail time. HIPAA violations are considered both CIVIL and FEDERAL crimes. Medical facilities such as CHCB and UVMMEd and institutions such as the Howard Center are NOT the commons. People in those settings DO have a legally protected right to privacy. Medical and health privacy laws are NOT something to fool around with. This is not a criticism, just advice.

@ Nope. If there was even a glimpse of the person any glimmer of a chance of soneone zooming in and identifying them, that puts the act of filming in violation. The right to reasonable expectation of privacy in these settings supercedes the right to record. This is even more so with private citizens (meaning, not official press or media) filming other private citizens. I am in support of citizen journalism but filming at a medical facility like this is not that... it's voyeurism and it's not right and it is actually illegal. If this were a car accident, a slip and fall, a crime, etc, anywhere around the city, in the commons, great. Totally legal and acceptable. But not here. Standing on the sidewalk and not on CHCB property proper is not a loophole, legally or ethically.
I do believe we've had this conversation once before on another video, so you probably already know what I'm going to tell you. I am literally going to copy and paste what I commented before, whilst adding more information afterwards, as it is the exact same story, and I might not have gotten the point across clearly last time. [[HIPAA does not apply to anyone who doesn't have official access to other people's personal health information. An average person, who doesn't work for an organization with access to personal information, in public, recording, is not subject to HIPAA at all, regardless of if they catch personal information on camera or not. The duty to protect this information to the best of ability is on the organization and the workers that have official access to it, and them alone.]] To clarify the above, a normal person can not violate HIPAA at all, period. He can't face any "legal repercussions" for laws that don't apply to him to begin with. You have every right to disagree with what he is doing in his videos, but that doesn't mean you need to attempt to construe his actions as unlawful. Whether or not it is morally acceptable to do it directly outside a medical facility while a patient is being cared for; that question is subjective, and I don't disagree with the opinion of it being less than right. The right to reasonable expectation of privacy is non-existent in public, barring extreme intentional invasions of personal space. As long as the person filming is on public property or a public sidewalk (as he is in the video), they can record anything within view. Standing on a public sidewalk, you have the right to film anything within your view, just the same as it is legal to look at it with your own eyes. To put this in perspective, imagine Times Square, Manhattan. You can likely picture all the windows in all of the tall buildings. Standing in Times Square, you take a picture to capture the entirety of the square itself. Now just try to comprehend all the private spaces you could view from this picture alone, just through all of the windows and open spaces. You can apply this same logic to a hospital, standing on a public sidewalk. In this hypothetical scenario, that would be a lot of criminal and civil liability. But that's not how the law works. It is completely on the owner, or entrusted inhabitant of the private space to create privacy. Whether this be with curtains or blinds, the photographer can't be held liable for viewing into someone's private space from public. This is exactly how HIPAA works. It is on the medical facility and the personnel to do their best to protect information and create privacy. If a private person, on public property or in an otherwise public space, just so happens to see it or capture it on video, the criminal or civil liability would fall on the medical facility/staff for failing to take appropriate measures to keep said information private. A small amount of individual research will reveal these facts I've addressed here, as well as the previous conversation we had about this topic.

FYI people, Vermont has the HIGHEST Police Misconduct Rate, IN THE NATION, per capita of its police officers (2004-2015). IN FACT Vermont IS three and a half times the National Average for Police Misconduct and public imprepriety. The Better Government Association's Alper Integrity Index scored Vermont as "49th IN THE NATION FOR GOVERNMENTAL INTEGRITY." When I called the Association's call line to perhaps find out why this was the case. What I found out was amazing. According to the Better Government Association, they explained that Vermont scored a FLAT ZERO in TWO OF THE FIVE GRADING CATAGORIES for the Index (Conflict of interest policy) AND (Whistle Blower Protections) bringing its overall score down to 49th IN THE NATION. Hamilton E. Davis Authored a book called " Mocking Justice" which detailed the crimes of former Vermont State Trooper, Paul Lawrence. The governor had to pardon over TWO HUNDRED PEOPLE BECAUSE OF former officer Paul Lawrence's involvement.. One can pick up a copy on Amazon relatively cheap as in less than Ten Dollars a copy.. The book documents more about the high cost of a state judiciary that affords very little oversight to its police, both local and State. Often times, the so called "oversight" is little more than the Fox in charge of the Hen House, quite literally. " Vermont's Department of Corrections is a broken system, IN THAT, ITS a front based response system, and needs to become a back based, preventative one." Or so said Former Burlington Police Chief Michael Schirling. Ward 6 NPA meeting. Spoke publicly on "community policing" at the Greek church on Ledge rd. I specifically attended this NPA meeting to listen to the chief of Police talk about a subject I studied years prior, "Community Policing". But then when I spoke to the then police chief on the telephone the chief completely lied about what he said, (the above DOC quote) it was an easy decision to make in putting his quote on the back cover of my book, "Vermont C.O. The Truth of Attrition" by C.Noll. simply because he denied saying it. And it is EXACTLY what the chief said. So what's the problem ?Well when a public official says something while in uniform at a public event he was specifically scheduled to speak at, IF he denies saying something, anything actually, it USUALLY some "bad thing." In THIS case because what the chief said about the Vermont Department of Correction was TRUE, entirely accurate and commensurate to my many years of research studying Criminal Justice, it was ironic because normally when a police officer denies saying something, it's usually : some negative r bad thing. But in this case, what the chief said was in my opinion, entirely truthful and accurate. He just didn't want to be associated with my book, so he actually lied and denied and made up some story to TRY and disassociate with me by completely lying through his teeth about the good thing that he said when speaking to a previously scheduled group on Community Policing while wearing a pristine uniform in front of numerous church goers This was later confirmed by CHANNEL 17 MEDIA FOR DEMOCRACY who's responsible for filming all of our Ward six NPA meetings which is where the chief spoke on community policing. It was the back half of December 2008 at approximately EIGHT O'Clock at night, where ALL of our ward SIX NPA meetings are held.
