    atty. ask ko lang ano po ang pwedeng hakbang para sa amin na hindi nila ni report as employee mula ng 2019? tapos po may SC decision na kami ay kanilang empleyado. hindi rin po kasi naging malinaw sa SSS na kami daw ay employee po, paano na po kami mga walang benepisyo?

    atty. kung wala bang master's report..wala po bang pag asa ang na makuha ang CBA nya? kasi umuwi yung husband ko di sya humingi ng copy kasi hundi nya naman alam na ganito pala kalala yung sakit nya sa cervical spine nya..akala nya sprain lng..covid noon kaya di sya na magamot abroad..pinauwi sya pero hinintay pa ng company na matpos yung contrata nya bago sya pinauwi ng pinas.

      If you are a SEAFARER, Finished Contract or Repatriated Contracted to illness or Injury, you should report to your company 72 hours upon arrival in the Philippines. Eto po yung mga benifits na makukuha niyo pag dating ninyo dito sa pilipinas. 1. Free medication- ang medication po ng isang seafarer na naaksidente/injury or illness on board ay tumatagal ng 120 days pero sa bago pong batas pinapayagan ang company doctors na iextend ang gamutan na hindi lalagpas sa 240 days. 2. SEAFARERS who are under Medication will have basic salary or Sickness Allowance for 4 months and also you can reimburse all your transportation expenses and hotel accomodation while you are under medication. 3. A SEAFARER is entitled to FILE a DISABILITY BENEFITS. (A seaman has more benefits if he is a union member or may Collective Bargaining Agreement o CBA ang kanyang barkong sinasakyan, like TCC, JSU, NIS, ITF, PSU, AMOSUP , etc…) ~ Kung kayo po ay may kamag anak o kakilala maari nyo po silang irefer sa amin upang mabigyan po namin sila ng TAMA at SAPAT na impormasyon na kailangan nila para hindi sila madala sa mga pangakong kani-kanilang mga ahensya. Alam naman po natin na ang buhay sa barko ay hindi madali kalaban natin ay lungkot at pangungulila sa mga minamahal natin. IPAGLABAN NYO ANG INYONG KARAPATAN BILANG MARINO. HUWAG po MAGPALOKO! This subject is not total repatriated but it happened: SEAFARERS'S DEATH - for the seaman Having serious injury/illness while his working/duty, that cause of his death. ILLEGAL DISMISSAL - for the seafarers under contract but eventually, having issues whether it's work related or personal issue that cause of his termination without any compliance and without any claims that will received upon situation (A few days/months on the ship).     Good day sir.I would like to ask if depression causing lack of sleep onboard is it valid reason to be repatriated?I am afraid the company might charge me with the repatriation cost.

Pag pinauwe ka ng nag pinas.. Kailangan magreport ka agad sa agency mo with in 72 hrs para macovered ka sa medical and ma endorse ka nila sa mga company doctor. 4. I eendorse ka nila sa hospital na kung saan covered sa insurance ng barkong sinampahan mo .. 5. Ipapagamot ka nila hanggang 120 days to 240 days. .at sa loob ng 120 days may mkukuha kang tinatwag na " BASIC ALLOWANCE " .pero pag umabot ka ng 5 months to 8 months or 240 days hndi kna covered sa basic alowance. Ang makukuha mo lang ay ung 120 days kasi yun lang po ang covered. 6.Pag itigil na nila ang gamutan mo after 120 days at papapirmahin po kayo ng fit to work wag po kayong basta basta pipirma. Maari po kayong lumapit sa mga MARITIME CONSULTANT para mabigyan po kayo ng kaukulang advise .para makuha nyo ang nararapat para sainyo.. Kasi ang mga maritime consultant lang ang kakampi nyo.     Pano po pag di kami binigyan ng notice? On the day po namin nalaman na tanggal na kami at last day na agad? 3 yrs ako sa kanila at ang separation pay ko is only one month of my salary and no prorated 13th month. Sana matulungan nyo po ako, salamat.

    Attorney baka pwede po matulungan makuha ko ang full disability ko seaman din ako naoperahan,nag file napo ako ng case sa isang law office nag hearing napo bat dko makuha ang full disability reward dahil wala daw po ako accident report may captains report naman naka state po doon ang nangyari,nag hearing napo ako subrang baba ng offer malakas naman case ko patulong po.

    Question Atty. May grace period po ba ang transfer? Like if the employer informed the employee that he/she will gonna be transferred will there be any grace period for the employee to be prepared? Like 15 days grace period like that?

Magsisimula ito pagdating ng Pilipinas. Para sa mga Finish Contract : Kung ang isang seafarer ay may iniindang karamdaman kailangan na magkapagreport agad sa company/agency within 72 hours (3days) at ipaalam ang kondisyon upang makapag UNDERGO ng Post - Medical treatment. Kung may makita man na illness o sakit, Obligasyon ng company na ipagamot ang isang seaman ng libre base na din sa nakasaad sa contrata. Under POEA rule, a seaman is entitled to 120 days illness/injury/sickness allowance (equivalent to 4 months basic salary) to be computed from the date of discharge. Within 120 days from the time the seaman had contracted an illness or injury, he should be assessed or declared fit to work or disabled. If the seaman is not satisfied with the findings of the company-designated doctor, he has the right to contest. Tatlo lang po ang tunay na benepisyo ng seaman; ang una ay ang ipagamot ang seaman ng libre, Meron po silang minimum of 120 day at maximum of 240 days para kayo ay magamot at ang pangalawa ay tatanggap ang seaman ng illness allowance na apat na buwan base po sa pinirmahan niya sa POEA contract at ito po ay magmumula sa principal o may-ari ng barko. At sa loob ng panahon na di kayo gumaling sa iyong karamdaman, illness man o injury ay dito na po papasok ang pangatlong benepisyo na ang seaman ay entitled sa disability benefits at ang may obligasyon na dapat magbayad sa kanya ay walang iba kundi ang main insurance o ang kanyang P & I CLUB na ang ibig sabihin ay Protection and Indemnity. Special sa mga seaman na napirata nabihag man o hindi. pag ang seaman ay napirata at nagkaroon ng truama eto ay covered sa (PTSD)-POST TRAUMATIC STRESS DISORDER -DISABILITY. At kapag may CBA po kayo kadalasan po eh dumadaan ng DOLE at natatapos sa NCMB (National Conciliation Mediation Board).
