IP Tech Tuesdays #50: IP questions and index of past episodes
#IPTechTuseday is two years old!
In this special retrospective and prospective episode I do two things:
(a) Share questions about IP that I have been pondering.
(b) Provide an index into and some samples of the past 50 episodes.
All episodes are recorded and shared, with slides (where I prepared them).
The questions I am pondering are open, exploratory questions and not howto or yes/no questions. As I collect answers I change the way I practice #IP.
The #IPQuestions I currently ponder and have explored somewhat in these 50 episodes are:
1. What is #IPstrategy, and how is it visualized & formalized
2. How much can be done for a client with how little IP & invention
3. How does a patent attorney work - with an eye toward education and using AI
4. What do IP users need to know about IP and how do we get them to know it
5. How do we relate to uncertainty - using IP and in IP
6. How does IP work, alone and in conjunction with other activities

IP Tech Tuesdays #49: waiting with IP
มุมมอง 121 วันที่ผ่านมา
Is it OK to wait to address #IP (intellectual property) issues in a company? Using this question as a starting point, in this #IPTechTuesday I consider more generally the role of time in IP, including tempo and various time scales relevant to IP. I also consider the interaction between different types of time and the times of the company vs the time of the outside world including the competitio...
Hot IP Pitch Workshop when you pitch talk
มุมมอง 11หลายเดือนก่อน
As part of the Hot IP Pitch workshop on November 28, 2024, I gave this mini lecture on pitching to CEOs. I will be changing this talk (mainly adding) based on the very interesting interactions between the attendees and the CEOs. As part of the workshop, the attendees needed to prepare a presentation to pitch to real CEOs. This talk gives them some guidelines as to what to consider as they prepa...
IP Tech Tuesdays #48: IP and the principles of war
มุมมอง 2หลายเดือนก่อน
Perennially nibbling away at the question of #IPStrategy. People often use military strategy as an inspiration for thinking about using #IP (intellectual property). Is it justified? In this #IPTechTuesday, I try to apply the "principles of war" to IP. My tentative conclusion is that due to very basic differences between IP and the military, many of these principles do not apply. I guess it is a...
Stacked bridging questions
มุมมอง 26หลายเดือนก่อน
How do you bridge the gap between founder language and patent attorney language? Founders talk about business needs and hopes, while patent attorneys talk about IP and patents and the like. One way that I found works for me is "stacked bridging questions". This is a series of questions that bridge the gap between our languages and help the founder and patent attorney understand each other. Ther...
IP Tech Tuesdays #47: Using IP to leverage a commitment strategy
มุมมอง 72 หลายเดือนก่อน
Wile E. Coyote chases the road runner until he suddenly bangs into a wall or falls off a cliff. This is both a business issue and an #IP issue. Business - Wile E. decided to commit to a certain activity, only to discover it was too commited. IP - Road runner works hard to help Wile E. make, maintain and then crash the commitment. That is exactly what IP can do for you - if you let it. In this #...
IP Tech Tuesdays #46: VP/IP and IP cycles
มุมมอง 182 หลายเดือนก่อน
VP/IP are invited to disagree. In this #IPTechTuesday I present my (current) vision of the position called VP/IP, which is not quite the same as an IP manager. I explain where I see the responsibilities of the VP/IP and especially involvement in the various IP cycles, and other processes that are IP adjacent. I find that the VPIP is a unique position characterized by: (a) a mostly informal powe...
OA response as a performance and an opportunity
มุมมอง 72 หลายเดือนก่อน
Responding to an Office Action (a letter from the patent office) is often considered a type of puzzle-solving activity - the patent office raised some issues and we need to figure out a way to overcome the issues. In this short talk, I explain why "performance & opportunity" might be a better lens on this activity. In fact, I argue that the puzzle-oriented view may result in a worse response an...
IP Tech Tuesdays #45: The Signature of Infringement
มุมมอง 63 หลายเดือนก่อน
You cannot sue for #patent #infringement if you are not aware of it! Some believe in the doctrine of #detectability- a patent claim has no value if you cannot detect it being infringed. But what if the infringement is done in secret? Signatures come to the rescue - they hint or prove that a secret process is actually making use of your valuable patent (or trade secret). In this #IPTechTuesday w...
IP Tech Tuesdays #44: Protecting Alternative Protein Innovations
มุมมอง 243 หลายเดือนก่อน
Napoleon famously said that you cannot make an omelet without breaking any eggs (actually it was François de Charette). Well, now we can. And we file #IP on it. In this #IPTechTuesday you are in for a treat (pun intended). Dr. Eran Noah, as a guest speaker, will be talking about some pitfalls and challenges in protecting #AlternativeProtein inventions and businesses. Dr. Noah is a Patent Attorn...
IP Tech Tuesdays #43: IP, Deception & Surprise
มุมมอง 54 หลายเดือนก่อน
Some types of #IP, like #patents, are inherently deceptive. But we can do better than that. Patents, for example, have some properties, such as authority, audience and complexity which make them very useful tools for deception activities. In this #IPTechTuesday we see examples of how deception & IP interact to provide interesting synergies. Slides: docs.google.com/presentation/d/1U8DchuD5k9AnQs...
IP Tech Tuesdays #42: IP, ecosystems and landscapes
มุมมอง 74 หลายเดือนก่อน
#IP loves leverage. #ecosystems have enough structure to provide multiple opportunities for leverage, especially using IP. In this #IPTechTuesday we see multiple types of interactions between IP and ecosystems. Find out why ecosystem IP moves are not only for the big players. We also touch on the relationship between landscape and ecosystem. Call out to Mingjin Guo's PhD thesis which investigat...
IP Tech Tuesdays #41: IP - learning, gaps, path and debt
มุมมอง 1214 หลายเดือนก่อน
Is "true innovation" the enemy of #IP? What about "the learning company"? In this #IPTechTuesday we discuss the relationship between learning and IP and how company development causes the creation of gaps in your protection, via mechanisms such as "intellectual debt" and "innovation debt". We also discuss the path dependency of IP creation and what might be done about it. Slides: docs.google.co...

IP Tech Tuesdays #40: when IP is the plus one
มุมมอง 115 หลายเดือนก่อน
#IP is great, but IP can be incredible when used with non-IP moves. But how do we even talk about a mixture of IP and non-IP moves? What do we do when IP shrinks or becomes holey during protection, will it still dance the tango? In this #IPTechTuesday i present a simple graphic framework for visualizing IP moves (the building blocks of strategy) working together with non-IP moves. The trick is ...
