LAW 26 of 2007 amended later by Law 33 of 2008 states a Tenant can only be evicted in set cases:
1.Your Landlord plans to use the property for personal use.
a. Must be personal use by immediate family.
b. You don’t have to move out, your landlord has to prove no other properties for personal use that are suitable.
c. And if your Landlord is a company, its difficult to prove a company needs an apartment for personal use or that unit has immediate family.
d. TENANT can move out and if re rented within 2 years can open a case.
e. TENANT can refuse to move out and ask their LL to open a case to evict and prove its needed for personal use.
2. Your Landlord wishes to sell the property.
a. This one is controversial.
b. Cases have been decided saying the new owner must give 12 months notice.
c. Last year guidance was given that the Legal Vacating notice attaches to the property and so the new owner does not have to give a new notice.
d. HOWEVER, if your new owner evicts you to re rent then it is possible they would be liable to a fine if you opened a RERA case.
3. Your Landlord wishes to renovate the property
a. This will rarely apply to apartments as the changes have to be so transformative that they need approval from Dubai municipality.
Landlords cannot email a Tenant to leave in 12 months. You must be served with a legal vacating notice via Dubai courts or a public notary.
