Update on TCPA and New FCC & FTC Rules
The Telephone Consumer Protection Act (TCPA), enforced by the Federal Communications Commission, and the Telemarketing Sales Rule from the Federal Trade Commission are the primary federal regulations controlling telemarketing to prospective students. The federal regulatory scheme includes the Do Not Call Registry, which is overseen by the FTC but also is an element of TCPA compliance. These regulations are critical in the federal government’s continuing efforts to protect consumers from telemarketing fraud and reduce telemarketing abuses and annoyances such as robocalls. Failure to comply with these regulations exposes a school to class actions and other litigation, enforcement actions, and expensive fines.
During this webinar, Thompson Coburn’s Higher Education litigators will provide an overview of these important regulations, including ongoing updates, and offer some practical guidance for reducing a school’s risks and enhancing compliance.
