We understand your concern regarding the CPA's role in this story. There are many complexities that can arise during a business setup and our goal is to provide insights to help our audience navigate similar challenges effectively.
A couple of issues to note here that seem to be missing in our discourse about medical estheticians. There is what your state license defines and what an industry skillset is. The other issue is the definition of "medical" services. The move to define some common services as "medical" that are common to an esthetician as well is a problem. An esthetician can absolutely expand their skill set and advertise that they have that skill set but cannot use the title. Estheticians have options for professional certifications that are not tied to a state license or change their scope but enhance their skill set. There is no FTC or cosmetology board guideline that restricts identifying skills gained. Estheticians are allowed to work under medical supervision and there are states where that is defined in scope, you will see it defined in a master esthetician license. Estheticians have been a vital part of the success of the medical spa industry and should be respected for their role instead of marginalized as seems to be happening in this industry.
Thank you for your input. We agree that each state is different and that some states allow an esthetician to provide an expanded scope of services, including providing medical services. Whether a service is considered medical or not is a matter of state law and often enforced by the medical board and sometimes the state’s attorney general office. The definition of the practice of medicine in most states is broadly written and dates back to the origination of the laws regulating medicine. They will use words like “anything affecting living tissue” and this leaves a lot of room for interpretation by the regulatory bodies. The main point of the episode is to be careful when using a marketing term like “medical esthetician” for the protection of both the esthetician, the practice, and any of supervising providers.
