$2,100 worth of Misfortune, gone in a puff of smoke
My anchor got snagged on abandoned logging equipment. Thanks to a series of mistakes and a series of unfortunate events, I lost all my chain and my brand new anchor. I haven't lost it yet. I'm still bobbing above it, trying to think of ways to save it.
There is quite a community of people living afloat as Nautical Citizens of Burgoyne Bay. They have made it a community challenge to help get my anchor and chain back. Very nice of them to help me. I haven't given up complete hope yet, but I'm starting to accept it is very likely lost for good.

Heading out tomorrow at the dawn to go to Cadbury Bay. The wind is going to be against me all the way. So I think I'll tuck the sails in and use my mighty diesel to power me the 100 or so kilometers at 4.5 knots (about jogger speed.) Never been to Cadbury Bay before.

Two Park Rangers came to visit me today. They asked how long I've been anchored here. I told them the truth. I have no idea. Could be three or four weeks at least. Burgoyne Bay has been home to Nautical Citizens for at least the past 50 years. One of the residents says there were people here before he moved in 40 years ago.     My cat fill overboard in Southern California, i was belowdecks napping. His cry was loud enough to wake the devil. Had a fish net to scoop him up that did not work. He swim around the 2 or 3 times and i was able to reach down and grab him. Then had to wash them off with fresh water. Luckily all this took place at anchor. After I got all done the cat was madder than hell and then would not come up on deck for three days. After that he was VERY careful.

    bye bye, don't let the door hit you on the way out. It's a park and yes they have jurisdiction. You get an F in law....So, why is why anchoring not prohibited in marine parks or, if not prohibited, at least subject to a fee? Jurisdiction in the marine environment is complicated, leaving provincial park authorities in particular uncertain whether they have the power to regulate anchoring. However, a review of case law suggests that this should not be an issue. Anchoring, and the right to constrain it, is indeed fairly complex. To begin with, everyone has a common law right to navigation, which includes the incidental right to anchor.6 However, such rights must not be exercised in ways that interfere with the equal rights of others. In addition, common law rights can be altered, or even overridden, by legislation. Do park authorities have the authority to regulate anchoring? That requires consideration of the division of powers set out in the Constitution Act, 1867. Under section 91, the federal government has exclusive legislative authority over buoys (s. 91(9)) and navigation and shipping (s. 91(10)). Within the province, the legislature, under section 92, has exclusive jurisdiction with respect to property and civil rights (s. 92(13)) and local or private matters (s. 92(16)). The province also has constitutional authority over the management of public lands, including provincial foreshore, under section 92(5). BC’s Land Act7 defines Crown land as “land, whether or not it is covered by water”. Anchoring, in at least some situations, is a core aspect of navigation and shipping. For example, anchoring for emergencies or repairs are included in one’s right of navigation. With primary authority for navigation, the federal government, and thus Parks Canada, clearly has the authority to regulate anchoring in national marine parks. The provincial authority is less clear. A province cannot validly enact legislation that conflicts directly with a subject area that the Constitution has assigned to the federal government. However, there is room for overlap. The Supreme Court of Canada has said: 8 ”In determining the proper test it should be remembered that in a federal system it is inevitable that, in pursuing valid objectives, the legislation of each level of government will impact occasionally on the sphere of power of the other level of 6 R. v. Lewis et al., 2009 BCPC 386 (CanLII), <canlii.ca/t/27tgz>, retrieved on 2020-11-16, at para 29. The court was considering regulations enacted by the federal government, in consultation with the City of Vancouver, limiting anchoring and mooring in False Creek. 7 R.S.B.C. 1996, c. 245, s. 1. 8 General Motors of Canada Ltd. v. City National Leasing, 1989 CanLII 133 (SCC), [1989] 1 SCR 641, <canlii.ca/t/1ft82>, retrieved on 2020-11-16, at para 45. Alternative to Anchoring in BC Marine Parks 4 government; overlap of legislation is to be expected and accommodated in a federal state.” In another decision, the same Court said:9 “The history of Canadian constitutional law has been to allow for a fair amount of interplay and indeed overlap between federal and provincial powers.” Given that jurisdictional overlap is allowed, and even inevitable, how can one determine when overlap is valid? The Supreme Court of Canada has clarified that provincial laws can affect areas of federal jurisdiction as long as they don’t actually impair federal laws:10 “The difference between ‘affects’ and ‘impairs’ is that the former does not imply any adverse consequence whereas the latter does… It is when the adverse impact of a law adopted by one level of government increases in severity from ‘affecting’ to ‘impairing’ that the ‘core’ competence of the other level of government … is placed in jeopardy, and not before.” BC’s highest court, our Court of Appeal, allowed a mere municipal bylaw (municipalities have very limited jurisdiction compared to a province) restricting the moorage of vessels to overlap with the federal authority to regulate navigation:11 “I agree with the District that upholding those regulations does not support the corollary that any provincial regulation of moorage or anchorage would be in pith and substance an invasion of the federal navigation and shipping power.”

      Met him at Fairy Creek and knew him as Smiley. He went off on his own and was never seen again. I'm sorry. I wish I'd come here sooner but things got really bad after we lost him and I've been working up the nerve to come to this channel for nearly a month now.

    Oh no... 😳 I brought an Albin Vega 27' that I'm gonna be living on the rest of my life. It's small but the upkeep will be very low. Will be fixing her up next spring and summer and in the fall I'll leave Sweden for Madeira island of Portugal where I will spend the winter (both Sweden and Portugal is EU, I can live where ever I want). In the spring I will leave for the fjords of Norway to fish, I love fishing and eating fish. After that I don't know... Maybe EU part of caribbean? Maybe south Africa?

      Gerald aka Smiley was lost on the mountain at Fairy Creek. RCMP and search and rescue won't look for him and our people were all arrested and dragged out of Ridge Camp where he was last seen. I only knew him a few days, but he was a beautiful person. He was very passionate about the mountain and the fight to save it. He said he planned to leave and come back after getting some training and getting fit and he could climb up and do a tree sit. He left early one morning by himself. We never saw him again. Some of us tried looking ourselves but Ridge was raided soon after. I had my head kicked in, was strangled and dragged off, and am still healing from a concussion or I'd still be there. I'm so sorry. His loss was a huge hit for all of us. I'll never live down what happened up there.

      @@clarencemumford5162 Thank you. I did find out what happened to him from his friend, who flew out from Toronto to look for him. Absolutely horrible. He was a dear friend of mine, and I feel his loss every day. A good soul. I'm sorry for what happened to you. The whole situation sucks, and it makes me wonder if maybe some loggers caught up to him and he got mouthy. It just seems weird to me that he disappeared without a trace.

      I'll tie a rope and a bouy to it. I'll give the locals 500 for the chain and anchor if they manage to salvage. A lot of smart people here with no money and a lot of time to think.

    here's an idea, if you think brute force will work..beg, borrow or source a large inflatable buoy, the ones sailboat racers use for their marks. Dive down a bit with it deflated and secure it well to the chain you can reach. Inflate it in that position with your hookah. This air bag will give a lot more force than your windlass ever could. Good luck from a fan in Long Branch!

      I think that is a great idea and in the future I will keep such a buoy in my equipment. Out here, even Amazon wont deliver. I might just tell the guys who are helping me to tie a bouy at the end of the rope. If they manage to salvage it, I will buy it from them for 500. There is a lot of ingenious people here with not much to do but be creative.

A large canvas bag or even a nylon sail bag for strength, lined with garbage bag for air tight all within a 'net' made of lines for strength? If you have a significant tidal drop you can try and use the buoyancy of the boat. Put as much tension as you can at lowest tide and as the boat rises, I may break free? THEN it would be music to hear your drift alarm!!

      @@paulpaul6721 It is hard to dive when nobody is in the boat monitoring the compressor. Also I would have to do it in stages. 300 feet of chain means I would have to dive six times, fifty feet each time. Between dives I would have to climb back onto the boat and pull in the slack. I don't have the stamina for such athleticism. I'm not 20 anymore. Tomorrow morning when the tide is out, 4 people are coming and we're going to rig a block and tackle from the mast and hopefully pull it up. It might break the rope. If this attempt fails. I'll tie the line to a buoy. Motor to Victoria, fix my windlass and then come back in June to retrieve the anchor. I'll also put out a 500 dollar bounty on it. The community here is very smart and underemployed. I'm sure they'll come up with some creative solution. At any rate, stay tuned I'm going to film our attempt.

      Heavy breathing because I had the idea of dangling all 6 docking lines and using them like tarzan to swing around the bottom. Not enough lead on my suit and a breathing line prone to tangle made it a struggle.

      It does have a keel. A fin keel. It doesn't run the entire length of the boat but it has 4,500 lbs of lead attached to it.
