I'm pretty sure they paid him off. This is different to the other emulator. They took money for giving ppl access to a version capable of running Tears of the Kingdom pre-release. So Nintendo rightfully sued them because while emulators aren't illegal, profiting of them is. I think they even offered a TOTK ROM but I could be misremembering. However, this emulator does in no way profit off their emulator so Nintendo have no grounds to sue them. So they more than likely paid him to stop any further development and remove his files from the internet. It has also been blown out of proportion because you can still get the emulator without issues. It hasn't been nuked off the internet. It's still very much available.

I get it if the console isn’t supported anymore, but while it’s still running, I see no reason to emulate

In 2018 a remake of Bowser's Inside Story was released, but the last original Mario and Luigi game was Paper Jam and that came out between 8 and 9 years ago, and Paper Jam had the same limitations as Paper Mario Sticker Star, so the last Great Mario and luigi game came out in 2013 with dream team, so yeah, it's been a very long time since we got a real new game
