Invasion is the antithesis of rules or rules based order, and therefore rules are out the window. The UN has been derelict in not yet having a General Assembly vote on a proportionality of response of 0.9 for 1. 0.9 to point to less war not more war. If the UN fails with such basic and fundamental comment or yardstick for moral authority and humanity, - it has truly failed. What is it doing?

Host of the video here! This is one of the most gut-wrenching scenes of the entire series. There's a lot the scene intentionally leaves as a grey area--is the man really a commandant? Is he still serving, but just in hiding? Is he a wrongfully accused civilian? Is he a former soldier who has left the service? I can't recall if this scene takes place before or after Germany's unconditional surrender...if it happened before the surrender and this man is still a soldier (albeit one in hiding), he can be lawfully targeted unless he's hors de combat for some reason (i.e. he surrenders or is otherwise captured by the Americans here). Disguising himself as a civilian doesn't change that fact. Him running away from the Americans wouldn't qualify as being hors de combat, so he could be lawfully targeted if the facts support it. If he's not a soldier (or isn't a soldier anymore), he's a civilian and can't be intentionally targeted. The same would go if this scene happened after Germany's surrender (there would be no armed conflict between Germany and the US, so IHL wouldn't apply at that point, making this murder). The moral tug of war is a much fiercer battle in the scene, though. As a Jewish-American soldier, Liebgott battles really understandable struggles throughout the conflict--particularly after they liberate the camp and the fighting ends. He's trying to do a "right thing" (at least in his mind) and, if he's correct in his assumptions about the man, target a detestable war criminal...but as a professional soldier fighting for the side with the unquestionable moral high ground, he and his squad mates have a higher duty. The hard right outweighs the easy wrong. Of course, that's easy to say 80 years later from behind a keyboard while detached from any sort of conflict.

I think Surgical strike was being referred to in the context of India's surgicak attack in pakistan post attack in Pulawama in Kashmir. After that pakistan brought down a fighter jet and captured the pilot. So t seems IHL of IACs will apply.

I have a question about the principle of distinction- Article 48 of the Geneva Conventions says that the combatants are supposed to distinguish themselves from the civilians for example by wearing a uniform, what if the combatants purposefully stay in highly populated areas and the opposition launches an attack which results in civilians getting effected, will the opposition be held accountable for breaching ‘principle of distinction’? PLEASE do reply as soon as you can, I'll be grateful
The rule of distinction is found in Articles 44 and 48 of Additional Protocol 1 of 1977. Article 51 contains additional rules for the protection of civilians, including the prohibition of actions using civilians as human shields. Even so, the adversary is not allowed to act in disregard of the rules of protection, being obliged to take all the measures provided by article 57 of AP1 (see paragraphs 7 and 8 of article 51).
