(b) (1)Whoever violates, or attempts or conspires to violate, paragraph (1), (2), (3), (4), or (6) of subsection (a) shall be fined under this title and imprisoned not less than 5 years and not more than 20 years, but, if such person has a prior conviction under this chapter, section 1591, chapter 71, chapter 109A, or chapter 117, or under section 920 of title 10 (article 120 of the Uniform Code of Military Justice), or under the laws of any State relating to aggravated sexual abuse, sexual abuse, or abusive sexual conduct involving a minor or ward, or the production, possession, receipt, mailing, sale, distribution, shipment, or transportation of child pornography, or sex trafficking of children, such person shall be fined under this title and imprisoned for not less than 15 years nor more than 40 years. (2)Whoever violates, or attempts or conspires to violate, subsection (a)(5) shall be fined under this title or imprisoned not more than 10 years, or both, but, if any image of child pornography involved in the offense involved a prepubescent minor or a minor who had not attained 12 years of age, such person shall be fined under this title and imprisoned for not more than 20 years, or if such person has a prior conviction under this chapter, chapter 71, chapter 109A, or chapter 117, or under section 920 of title 10 (article 120 of the Uniform Code of Military Justice), or under the laws of any State relating to aggravated sexual abuse, sexual abuse, or abusive sexual conduct involving a minor or ward, or the production, possession, receipt, mailing, sale, distribution, shipment, or transportation of child pornography, such person shall be fined under this title and imprisoned for not less than 10 years nor more than 20 years. (3)Whoever violates, or attempts or conspires to violate, subsection (a)(7) shall be fined under this title or imprisoned not more than 15 years, or both. (c)It shall be an affirmative defense to a charge of violating paragraph (1), (2), (3)(A), (4), or (5) of subsection (a) that- (1) (A)the alleged child pornography was produced using an actual person or persons engaging in sexually explicit conduct; and (B)each such person was an adult at the time the material was produced; or (2)the alleged child pornography was not produced using any actual minor or minors. No affirmative defense under subsection (c)(2) shall be available in any prosecution that involves child pornography as described in section 2256(8)(C). A defendant may not assert an affirmative defense to a charge of violating paragraph (1), (2), (3)(A), (4), or (5) of subsection (a) unless, within the time provided for filing pretrial motions or at such time prior to trial as the judge may direct, but in no event later than 14 days before the commencement of the trial, the defendant provides the court and the United States with notice of the intent to assert such defense and the substance of any expert or other specialized testimony or evidence upon which the defendant intends to rely. If the defendant fails to comply with this subsection, the court shall, absent a finding of extraordinary circumstances that prevented timely compliance, prohibit the defendant from asserting such defense to a charge of violating paragraph (1), (2), (3)(A), (4), or (5) of subsection (a) or presenting any evidence for which the defendant has failed to provide proper and timely notice. (d)Affirmative Defense.-It shall be an affirmative defense to a charge of violating subsection (a)(5) that the defendant- (1)possessed less than three images of child pornography; and (2)promptly and in good faith, and without retaining or allowing any person, other than a law enforcement agency, to access any image or copy thereof- (A)took reasonable steps to destroy each such image; or (B)reported the matter to a law enforcement agency and afforded that agency access to each such image.

This was a fantastic interview and I feel really blessed to live in Orange County. When my wife and I got married in 2006 and moved to Lake Forest we knew this was a safe place to raise a family. Every once and a while when OCSD would be in the news I would half hardly joke that if we lived in LA county and had LASD, that’d be a $hit show. So thank you Sheriff Barns for all that you’ve done for OC and doing it w/ the utmost integrity and respect.

The sheriffs deputies in Santa Ana County jail intake are some of the worst human beings I have ever encountered in my life! I was wrongly charged and only there for 12 hours and it was the most demeaning horrible things I have ever seen! I never thought humans could treat other humans so horrible in America! Lawsuit still pending.

Please reach out to your your friend, Sheriff Barnes, and ask him to take a long hard look at the evictions Department. It is in fact very broken. I am a complete victim of the Departments inadequate resources as far as certified deputies are concerned to serve evictions. I've spoken to a ground level certified Deputy & Sgt. Cisco. The female deputy officer that I spoke with explained to me how basically it works even with the simplest of evictions. And speaking to Sergeant Cisco he pretty much reiterated what the femaldeputyty had explained to me. My issue is this whole waiting in line process, it's very broken, and here's why. While I'm in line waiting for businesses to get evicted, homes where there are families or one person living in that home to get evicted that are in front of my case, I am dealing with a in home mentally unstable resident who was supposed to be evicted back on June 9th. I don't believe the line process that goes back to grade school should simply apply to something as complicated as evictions. There should absolutely be categories in how these are handled categories for business categories for homes that are inhabited with a group of people, let's call it a family. Then, there should be a category that covers evictions of multiple inhabitants of a property in which one or a few, not all of the inhabitants, need to be removed. Dealing with people who are suffering from mental illness that are in the limbo stage that haven't caused physical harm to someone as of yet or caused property damage that exceeds the amount that the law will engage in really ties the hands of local law enforcement when it comes to cause of service. I can easily go into so many situations that need to be corrected or added into law by our California legislators, but that's not what my comment is about. My comment is geared towards you having a conversation with Sheriff Barnes regarding something he can fix without adding laws without going to the legislature. This can be fixed under the roof of the OC Sheriff's Department. If they want to capitalize and dominate the responsibility of handling all evictions from simple to complicated, then they absolutely need to have the correct staffing to handle things in a much more reasonable time frame. 6 weeks to 2 months is simply ridiculous and unacceptable when you're dealing with evictions like the one I am dealing with, forget the financial aspect when you're dealing with a person who is unstable under your roof and that can cover a lot of situations whether the person is into drugs or a drinking issue or like I'm dealing with a mental instability issue it is truly a nightmare it is unlike a property owner that can claim a loss with paperwork to back on filing next year's taxes. Very different situations. So, as you said, he's your friend. Make some time to go over this with him.

Thank god I was already heavy into yoga, lap swim, walking, bike riding. I’m still teaching part time voice, ukelele, guitar, performance. I sing a lot every morning. Great for voice and energy! But energy and motivation are so low! I’ve added PT 3x weekly for 2 years now, a little basketball, chi gong (2 people online swear they went into remission). Don’t know if boxing is the be all and end all? Your opinion? I have 3 infrared/photobiomodulation devices! One has cured constipation. A lot of coco oil mct oil olive oil. Good diet! A massage gun every morning and evening has been indispensable!. Especially on hands and feet! Cold showers are the best! I’m about to try cryotherapy. Driving is no fun..hard to be quick and alert! Playing my guitar and uke has declined..but still do it. Swimming and bike riding are still easy. And the vertigo is never ending! Anyway..your talk was an inspiration..especially when I was thinking I’ve tried everything!
